- It should fall under the definition of a trademark prescribed in the Trademark Act:
- It should not fall into any of the following cases that are unregistrable trademark under the Trademark Act.
– a trademark which is identical or similar to another person’s pre-filed or registered trademark of which goods are likewise similar or identical to each other;
– a mark which consists solely of a sign indicating, in a common way, the origin, quality, raw materials, efficacy, use, quantity, shape, etc.;
– a mark which consists solely of a sign indicating, in a common way, the usual name of the goods;
– a mark which consists solely of a very simple and commonplace sign;
– a mark which consists solely of a sign indicating a conspicuous geographical name;
– and others falling under the same category.
